This article focuses on access on foot, by bicycle, on horseback or along a waterway, while the judicial route (transportation) focuses on land use rights for highways, railways, pipelines. The Prudential Center in Boston, Massachusetts, is one of the earliest and most important ROW Use Agreement projects over an interstate highway. This mixed-use development with a 750-foot office tower and residential and commercial space was built in 1957 above a Boston Extension ramp of the Massachusetts Turnpike for $200 million. Other notable air rights projects were built on i-5 in Seattle, I-35 in Duluth, Minnesota, I-670 in Columbus, Ohio, and the FDR drive in New York. The development of air rights (ARD) on/under public assets can achieve a number of intelligent growth principles while being a tool for collecting soil values. However, there are several complexities related to ARD, as well as bureaucratic resistance to an unknown form of development. This master`s work explores the different ways in which a public institution can meet these challenges and put in place an effective implementation structure for ARD. The launch ceremony for „Putting London on the Map“ took place at the British Library and, since then, „the Inner London Area of the Ramblers has been working with collaborators from the Ramblers Central Office to convince everyone in the Inner London Boroughs that it is desirable to draw up definitive maps of the rights of way.“  The amount of built storage space that can be created on a ROW use agreement package is determined by the zoning name of the site. Zoning denominations identify both the type of construction to be built and the surface that can be developed with a surface ration name (FAR). The FAR is the ratio of the total amount of built-up area eligible for square metres of land. If the base area built on land is less than the maximum allowable area, the unused area can be transferred to neighbouring parcels through ROW use agreements. Under UK law, public access to waterways is limited and only 2% of all rivers in England and Wales have public access rights. The BCU is not only using the campaign to raise awareness of access issues, but also to try to change the legislation. In England and Wales, with the shutdown of the 12 Inner London Boroughs and the City of London, public roads are routes through which the public has a legally protected passport and combrsion right. The law of England and Wales differs from that of Scotland in that the right of way exists only if they are (or can be named) so designated, whereas in Scotland any itinerary meeting certain conditions is defined as a priority right and there is also a general presumption of access to rural areas.
